Kenya permanent residence: who qualifies and how to apply
Permanent residence (sections 37–39, Kenya Citizenship and Immigration Act 2011)
In short
Kenya grants permanent residence to four groups: former Kenyan citizens, foreigners who have held work permits for at least seven years and lived in Kenya continuously for the last three, children of Kenyan citizens born abroad, and spouses married to a Kenyan citizen for at least three years. Applications are filed on eFNS and submitted at Nyayo House; lawful residents pay KES 50,000 to apply and KES 750,000 on approval, and the Directorate's charter allows up to 24 months.

The four categories
Sections 37 to 39 of the Kenya Citizenship and Immigration Act 2011 govern permanent residence. Category A covers people who were citizens by birth but renounced Kenyan citizenship because their new country does not allow dual nationality. Category B covers lawful residents who have held work permits for at least seven years and have lived in Kenya continuously for the three years before applying. Category C covers children of Kenyan citizens born abroad who took the citizenship of their country of domicile. Category D covers spouses of Kenyan citizens married for more than three years in a genuine marriage.
For a foreign professional or business owner, Category B is the realistic path: it builds on years spent on Class D, G or similar permits. Lawful-resident applicants must also show a strong position to contribute to Kenya's socio-economic development and attend an interview in person to verify this.
Documents for lawful residents and spouses
Lawful residents (Category B) submit the printed online forms and payment acknowledgement, two passport photos, copies of all permits issued in Kenya, a valid passport copy, a certificate of good conduct, a valid tax compliance certificate, a valid alien card and a cover letter to the Director General requesting permanent residence. Spouses of Kenyan citizens (Category D) provide copies of all permits or Dependant's Passes held, the passports of both spouses, the marriage certificate, a joint affidavit if the marriage took place outside Kenya, a certificate of good conduct, a tax compliance certificate, an alien card and an application letter.
All applications include Form 23, the questionnaire and the eFNS payment receipt, together with the checklist documents.

Living as a permanent resident
Permanent residence has indefinite validity and is not renewed, but holders over 18 keep a foreigner certificate (alien card) renewable every three years. Status can be revoked under section 39 of the Act, for example after certain criminal convictions. Permanent residents may later apply for Kenyan citizenship if they meet the citizenship requirements; the charter lists citizenship by registration for lawful residents as a separate service.
