Germany fast-track procedure for skilled workers (§ 81a)

Accelerated skilled-worker procedure (§ 81a AufenthG)

In short

Germany’s only official fast-track for visas is the accelerated skilled-worker procedure under § 81a of the Residence Act: your future employer authorises a foreigners authority in Germany to steer recognition and approvals for a fee of EUR 411. Once the authority issues its pre-approval, the German mission must offer a visa appointment within three weeks and normally decides within three weeks of a complete application.

Key facts

Fee
€411Fee for the accelerated procedure under § 47 AufenthV, normally paid by the employer; the visa fee of EUR 75 is charged separately.
Processing time
Recognition authority: decision within two months; Federal Employment Agency: one week; mission: appointment within three weeks and decision usually within three weeks of a complete application.
Where to apply
Started by the employer at the foreigners authority in Germany; the visa is then applied for at the German mission responsible for your place of residence.

Who can use it

The procedure covers people coming for vocational training (§ 16a), for measures to obtain recognition of a foreign qualification (§ 16d), as skilled workers with vocational or academic training (§§ 18a and 18b), for the settlement permit for highly qualified persons (§ 18c(3)), for the EU Blue Card (§ 18g) and for other qualified employment. A spouse and minor unmarried children are included if they apply for their visas at the same time. Only the employer can request it, using your written power of attorney; the employer may in turn authorise a third party.

What it costs

The procedure costs EUR 411 under § 47(1) no. 15 of the Residence Ordinance and is charged to the party that requests it, normally the employer. The recognition body’s own fees and the EUR 75 national visa fee are paid separately.

How it works

The employer signs an agreement with the competent foreigners authority setting out the documents, steps, deadlines and consequences of breaches. The authority advises the employer, starts the recognition or degree evaluation, obtains a professional licence for regulated occupations and requests the Federal Employment Agency’s approval. Once all conditions are met it issues its pre-approval (Vorabzustimmung) and informs the German mission. If the qualification is only partly equivalent, the procedure can continue towards a § 16d visa for a qualification measure.

  1. Agree with your employer to use the accelerated procedure and sign a written power of attorney for them.
  2. The employer signs the agreement with the foreigners authority and pays the EUR 411 fee.
  3. Send your qualification documents for recognition; the authority also obtains the Federal Employment Agency’s approval.
  4. The authority issues the pre-approval and informs the German mission; the employer passes it on to you.
  5. Request the visa appointment at the German mission responsible for your place of residence; it must be offered within three weeks.
  6. Submit the complete application and pay EUR 75; spouse and children apply at the same time. A decision usually follows within three weeks.

Deadlines

The recognition body confirms receipt within two weeks and should decide within two months of receiving the complete file, extendable once with reasons. The Federal Employment Agency’s approval is deemed given if it does not object within one week. The mission then offers an appointment within three weeks of your request and normally decides within three weeks of a complete application.

Other ways to speed things up

Apart from § 81a there is no official way to jump the queue: appointments follow the order set by the mission, including on the Consular Services Portal. Optional extras sold by service providers, such as a VIP service, do not shorten the decision, and the missions warn against paying agents.

If the visa is refused

A pre-approval speeds up the file but does not guarantee the visa; the mission still checks every condition. German missions no longer offer the informal remonstration procedure, so after a refusal you either lodge a new application or use the legal remedies provided by law.

Frequently asked questions

Can I apply for the fast-track myself?

No. Only the employer in Germany can start it, with your power of attorney.

Can my family use the same procedure?

Yes, spouse and minor children can be included if they apply at the same time.

Can I pay a service provider for a faster appointment?

No. Optional extras such as a VIP service do not change the order of appointments, and the decision time does not change.

Does the pre-approval guarantee the visa?

No. It shortens the procedure, but the mission still examines the application and can refuse it.
